270-31. Fences. [Amended 9-25-1986]
  1. Fences within 15 feet of lot lines may be erected to a height of not more than five feet. Beyond 15 feet from a lot line, fences can be erected to a height of not exceeding six feet. Exceptions to these limits may be granted by the appropriate board upon notice and finding of hardship.

  2. Opaque fences to a height of not more than eight feet may be permitted on exterior lot lines, solely for the purpose of meeting the light trespass requirements of § 270-32.1.

    1. Editor's Note: This section also provided for the redesignation of former Subsections B and C as Subsections C and D, respectively.
  3. No person shall erect or maintain any type of barbed wire or electrified fence in the Borough. The height of fences on corner lots shall be regulated by the provisions of Chapter 256, Visual Obstructions. (See below)
  4. Fences in residential zones shall be installed so that the finished side of the fence faces the street or the neighboring property.

Special Notes:
  • A UCC construction permit (which includes zoning compliance) is required for all fences enclosing swimming pools, or exceeding 6 feet in height, or for tennis courts.
  • A Zoning permit is required for all other types of fences.
  • If any fence or part of a fence will be placed on any easement or right of way, then a special agreement must be entered into between the Borough of Allendale and the owner of the property where the proposed fence is to be placed.
  • All fences must be installed with the “finished” side facing outward.
  • Fencing may not be erected on any designated wetlands or wetlands encroachment zones without permission from the State of New Jersey.

256-1. Preservation of public safety; responsibility of owners. [Amended 9-25-1986]

Where it shall be necessary and expedient for the preservation of the public safety, the owner of lands may be required to cut any or all brush, hedges and other plant life growing within 10 feet of the edge of the paved portion of any roadway and within 25 feet of the nearest junction of the paved edges of two intersecting streets to a height of not more than 30 inches above the crown of the road at the nearest point.
