I have read the special considerations for the proposed use and certify that my application complies with the regulations under TCO 1133.04 except as listed below:

SPECIAL INSTRUCTIONS TO APPLICANT FOR CONDITIONAL USE REQUEST

 The applicant is urged to discuss with the City Zoning Administrator the nature and legal limits of such a request under the Zoning Ordinance prior to submittal of Conditional Use Application.
 The following documents must be uploaded with this application under the Required Attachments section
A. A copy of a vicinity map of the area designating the site involved.
B. A copy of a site plan of the site involved, drawn to standard engineers scale of 1" = 20 feet.
The site plan can be a single line drawing and must show property lines and dimensions, location and dimensions of all buildings , and setbacks from lot lines. The applicant must also show on the site plan all of the applicable items listed below:

  •  Location of streets, sidewalks and rights-of-way adjacent to the property.
  •  Location and size of existing buildings and accessory structures.
  •  Location of drainage and utility easements.
  •  Location and number of driveway entrances and exits.
  •  Location of any other on-site landmarks affected by the Conditional Use Request.
  •  Location of regulatory floodplain if any portion of the parcel is located within a floodplain.
  •  Location and character of any display of goods and services.
  •  Location and character of proposed parking lot landscaping and screening, including on -site trash collection facilities.
  •  Proposed parking plan and on-site traffic circulation pattern including lane markings, directional signage, and dimensions.
  •  Preliminary storm water detention/retention facility and drainage calculation.
  •  Existing and post-construction contour lines (grading plan).
  •  Proposed public improvements, i.e. sidewalks, street widening, etc.

C. A narrative of statement of operation, including hours of operation and any other information that will explain the operation.

D. Upon completion of review of the application for the Trotwood Board of Zoning Appeals, you will be notified via email when the hearing date of your application is scheduled. Failure of applicant to attend the Public Hearing may result in a delay of a decision or cancellation of the case.

E. Applicant may withdraw the application during any stage of its processing by emailing or giving written notice to the Trotwood Board of Zoning Administrator; however, the application fee is non-refundable

I understand that upon approval of a Conditional Use Permit, it applies only to the applicant/business owner. A Conditional Use Permit is a contract between the City, the property owner, and the applicant/business. Upon termination of the use or upon change of business ownership, the Conditional Use Permit shall be considered REVOKED and the use may not be continued or resumed without prior approval of the Board of Zoning Appeals.

Day Care Center: 13 or more children
An applicant for a conditional use permit to operate a day care group home shall submit all of the information required of day care centers except a license from the Department of Job and Family Services, State of Ohio.
If you are operating an LLC, provide a copy of your State of Ohio Registration Number.
Adult Group Homes
  • Provide a copy of the State Registered LLC from the department of State.
  • Provide a copy of the DODD required Plan of Operations including the Communication Outreach section.
  • Attach a copy of your training verification numbers
  • Provide evidence of the financial resources available to operate the facility.
  • Provide a copy of a license authorizing operation of a day care center from the Department of Job and Family Services, State of Ohio.
  • Provide a detailed plan of services and/or programs to be offered the children utilizing the day care center.
  • Provide evidence that both fire prevention and property maintenance inspections have been made of the structure proposed to contain the day care center, as well as evidence that such building is free of any violations of local and/or State laws or codes.
  • Attach site plans and drawings which show the location and dimensions of the lot, any existing or proposed structures on the lot, recreation and open space facilities, and landscaping and/or screening areas.
  • Attach floor plans with all room dimensions, points of ingress and egress
  • Attach evidence of insurance adequate to cover the cost of fire, theft, vandalism and liability.
  • Attach a copy of the Completed the JFS 01250 “Child Care Plan of Operation” for centers or the JFS 01335 “Type A Home Plan of Operation”
     
Day Care Home: 1-6 Children (Type B)

In addition, an applicant requesting permission to establish and operate a day care group home
shall submit:

  • Evidence that the group home provider will be the resident occupant of the property proposed to be used as a day care group home.
  • Evidence that the administrator of the day care group home has utilized the training resources of an appropriate County or region-wide social services agency.
  • Attached a copy of your completed JFS 01335 “Type A Home Plan of Operation
  • Attach a copy of your training verification number.
  • If the applicant is not the owner of the property, Attached a signed notarized statement authorizing the Tenant to operate a Type A daycare at the home.
Day Care Group Home: 7-12 Children (Type A)

All day care homes shall meet the following minimum standards:

  • Attach site plans and drawings which show the location and dimensions of the lot, any existing or proposed structures on the lot, recreation and open space facilities, and landscaping and/or screening areas.
  • Attach floor plans with all room dimensions, points of ingress and egress
  • Evidence that the day care home provider will be the resident occupant of the property proposed to be used as a day care home.
  • No day care home shall be permitted to be established within 300 feet of another day care home, or within 1,000 feet of a day care center or day care group home.
  • Every zoning permit issued for the establishment of a day care home shall annually be renewed by the day care home provider with the Zoning Administrator.
  • If the applicant is not the owner of the property, Attached a signed notarized statement authorizing the Tenant to operate a Type A daycare at the home.
